From Tony Garr of the Tennessee Health Care Campaign:
I spoke to a client this morning who thought that, because he had seen in the news media that the federal court had ordered everyone's reinstatement, it was no longer necessary for him to appeal the termination of his TennCare coverage. THIS IS NOT CORRECT
ENROLLEES WHO HAVE BEEN TERMINATED OR NOTIFIED THAT THEY WILL BE TERMINATED SHOULD STILL APPEAL IF THEY DO NOT AGREE OR UNDERSTAND WHY THEY WERE TERMINATED.
The state is seeking a stay of the Rosen ruling from the 6th Circuit Court of Appeals in Cincinnati. If the state succeeds, the protection provided by Judge Haynes' order of last week will no longer exist.
Therefore, people who have doubts about whether they were terminated improperly should be sure to file TennCare appeals right away and should continue to pursue those appeals until told differently.
In addition, Friday, December 27 is the last day for the 59,800 people who were terminated on November 29 or 30 to appeal and get their coverage back with no break in coverage. The best way to appeal is to fax your appeal to TennCare Solutions, toll-free fax number
